What are the exemptions for felling?
If a tree is dead or dangerous it is exempt from Tree Preservation Orders (TPO) and conservation area legislation. Under these circumstances it is best to take a photograph and notify the council's tree officers that a tree is to be felled under one of these exemptions.
If a tree is felled under these exemptions then a replacement tree will need to be planted in the next available planting season.
If a tree is proven (by way of Engineers Reports, Subsidence Reports, etc) to be causing a legal nuisance then it would also be exempt from the legislation.
