Smoke Free Legislation
The national ban on smoking in enclosed or substantially enclosed public places and workplaces came into effect on 1 July 2007.
The borough council is responsible for the enforcement of smoke-free legislation within Cheltenham. There are three offences identified in the legislation:
- Smoking in a smoke free place or vehicle;
- Not displaying appropriate no smoking signage in a smoke free place or vehicle;
- Allowing smoking in a smoke free place or vehicle.

Who will enforce the new law?
The manager on duty will be expected to ensure that staff and visitors do not smoke in their premises. Our enforcement officers will be responsible for enforcing the smokefree legislation across the town. It is likely that compliance checks will be carried out as well as the investigation of any complaints.
