Cheltenham Borough Council secures successful prosecution against developer for unlawful tree removal
Churcham Homes Holdings Ltd pleaded guilty to the offence of removing an oak tree safeguarded by a Tree Preservation Order (TPO) without the necessary consent
Cheltenham Borough Council is pleased to announce a successful legal action against Churcham Homes Holdings Ltd for the unlawful felling of a protected oak tree at Greenway Park, formerly known as Cromwell Court.
The case, concluded on 17 August 2026, at Cheltenham Magistrates Court, underscores the council's commitment to preserving the town's natural heritage.
Churcham Homes Holdings Ltd pleaded guilty to the offence of removing an oak tree safeguarded by a Tree Preservation Order (TPO) without the necessary consent, a violation under section 210(1) of the Town & Country Planning Act 1990. The court ordered the developer to pay a fine of £3,000, which was reduced to £2,000 due to their guilty plea, alongside a victim surcharge of £800 and full costs amounting to £3,362.52, totalling £6,162.52.
The unauthorised felling occurred on a building site at Greenway Lane, Cheltenham, during the site's development by Churcham Homes. This decisive legal action reflects the importance Cheltenham Borough Council places on protecting its green spaces and serves as a deterrent to potential future violations.
Councillor Paul Baker, cabinet member for planning and building control, said: "This prosecution sends a clear message that Cheltenham Borough Council will not tolerate illegal acts that harm our environment. We will continue to work diligently to protect our natural assets and ensure that developers understand the importance of adhering to environmental regulations."
