Fines for environmental or anti-social offences

The council can choose to issue a fixed penalty notice (FPN) instead of seeking prosecution through the courts for a range of environmental and anti-social behavior offences. An FPN offers you the chance to discharge your liability for an offence, meaning in some cases you avoid prosecution and a possible criminal record by paying a financial penalty instead. 

An FPN can be issued on the street if an offence has been witnessed by an officer. You may also receive a FPN in the post if it is not appropriate to issue in person or following an investigation. If the FPN is issued on the street, the officer will explain why it is being issued and how to pay it. 

Parking fines

An FPN is not the same as a Penalty Charge Notice which are issued for parking contraventions. 

Prosecution

For more serious cases, repeated offences or depending on the conduct of the individual,  the council may choose to go straight to prosecution.

Appeals

If you are unsure why the FPN has been issued, you should discuss this with the issuing officer. 

You cannot appeal a FPN. If you dispute that you committed the offence and do not pay the FPN, the council will commence prosecution proceedings and you will be provided with a court date where you will be able to plead your case to the Magistrate's Court.

How to pay a fine

The fixed penalty notice will clearly explain how to pay the fine and the timeframe you have in which to pay. 

Certain offences will have the offer to pay a discounted fee if payment is made within 10 days of the fine being issued. Please note that you cannot pay the reduced fee after the 10 days and if you make the reduced payment after the stated date, you will not have discharged your liability and will need to pay the full amount. Failure to do so will lead to further action being taken by the council.
