Why we collect information about you

We collect information in order to enforce, regulate and manage our car parks.

What information do we collect about you?

Civil enforcement officers (CEOs) will check all vehicles in our car parks to ensure they are parked in accordance with Cheltenham Borough Council off-street parking orders and the Traffic Management Act 2004.

  • Vehicle Registration Mark (VRM)
  • Name and address of the registered keeper
  • Name and address and place of work (permit applications)
  • Your contact details – where you provide them - email/telephone numbers
  • CEOs also use body-worn video (BWV) to protect council staff undertaking their duties. The personal data we collect from you through the use of activated BWV will include:
    • video recording
    • audio recording

Who do we share the information with?

  • DVLA
  • Enforcement agencies
  • Human resources (Staff only)

In relation to any BWV footage required for prosecution:

  1. Third parties such as legal services provider, counter fraud unit (CFU), Solace and Police
  2. Your solicitor or legal representative
  3. The courts

Is any information transferred to or stored on servers based outside the European Economic Area?

No.

How long do we keep your information?

Penalty Charge Notice information is kept for 24 months following payment or a successful challenge.

Information you provide when applying for a parking permit is kept until six months after you return an unwanted permit and no longer require the use of one.

BWV recordings will be kept for initial 30 days retention to await result of any further action. If no further action is required, the footage will be deleted.

What are the consequences if we do not collect the data?

The council will be unable provide a fit for purpose parking facility to residents, visitors and business or comply with the Traffic Management Act 2004 or Cheltenham Borough Council off-street parking orders.

Are any decisions about you made by automatic means?

No.
