Consent for the display of advertisements

Express Consent

Separate planning control measures apply in relation to the display of advertisements and are controlled under the Town and Country Planning (Control of Advertisements) (England) Regulations 2007.  Consent is required to display all outdoor advertisements, except in specified cases, and requires the submission of an advertisement application form, details of the advertisement and the appropriate fee.

Deemed Consent

There are a various advertisements that may be displayed under the deemed consent provisions of the legislation, which permits the display of certain classes of advertisements without the need to obtain specific express consent.  However, there are a number of complicated restrictions relating to the size, type, form and position of the advertisement that need to be complied with in order to conform for deemed consent.

The display of advertisements without consent is a criminal offence which may be the subject of prosecution and a heavy fine.
