S106 planning obligations

S106 planning obligations may cover one or more of the following:

  • restricting the use of the land or the way in which a development is to be carried out
  • requiring specific operations or activities to be carried out
  • requiring the land to be used in a specific way
  • requiring a sum or sums of money to be paid to the local planning authority for a specified purpose
Planning obligations may also be used for a wide range of purposes. However, current government guidelines detailed in the National Planning Policy Framework (NPPF), give a clear set of rules which planning obligations must adhere to. They must be:
  • necessary to make the development acceptable in planning terms
  • directly related to the development
  • fairly and reasonably related in scale and kind to the development
